SUPERSELF Terms and Conditions

1. Acceptance of Terms

Welcome to SUPERSELF! These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SAGA, LLC ("Company," "we," "us," or "our") regarding your use of the SUPERSELF mobile application (the "App").

SUPERSELF is designed to help you be more productive, energized, and focused through intentional time management and digital wellness practices. By downloading, installing, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Description of Service

2.1 SUPERSELF App

SUPERSELF is a productivity and digital wellness mobile application that helps you develop healthy habits and powerful awareness to have greater control and focus throughout your days. The App enables users to:

• Use the Intentional Timer (Productivity Timer) to practice intentional rest and focus sessions
• Track daily streaks and build consistent productivity habits
• Monitor activity time in intentional calm and intentional focus sessions
• Record daily productivity journal entries with ratings and reflections on energy, productivity, and focus
• Interact with the Productivity Coach (AI assistant) for personalized support and focus tips
• View progress through profile tracking, streaks, and activity data
• Manage profile settings and preferences

2.2 Core Features

Our App includes the following features:

• Intentional Timer: Set timers for intentional rest periods (walk, run, relax, meditate) and focus sessions (writing, designing, coding, reading, etc.) to practice being intentional with your time and energy
• Productivity Journal: Daily ratings and reflections on your energy, productivity, and focus to track what influences your performance
• Productivity Coach: AI-powered assistant that provides personalized focus tips and support based on your journal entries and progress
• Streak Tracking: Visual progress tracking through daily streaks of using the Intentional Timer
• Activity Analytics: Total time tracking for calm and focus activities
• Profile Management: Customizable user profiles with streak information and activity overview

3. User Accounts and Registration

3.1 Account Creation

To use our App, you must create an account by providing accurate and complete information. You may sign up using:

• Apple Sign-In
• Google Sign-In
• Email and password

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.2 Account Requirements

You must be at least 13 years old to create an account. Users under 18 require parental consent to use the App.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information and to update such information to maintain its accuracy.

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You will not:

• Use the App in any way that violates applicable laws or regulations
• Interfere with or disrupt the App's functionality or security
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App for commercial purposes without our written consent
• Impersonate any person or entity or misrepresent your affiliation
• Reverse engineer, decompile, or disassemble the App

4.2 Content Standards

When creating journal entries, reflections, or other content within the App, you agree that your content will not:

• Contain hate speech, harassment, or discriminatory language
• Include inappropriate or offensive material
• Violate the privacy rights of others
• Infringe upon intellectual property rights
• Contain malicious code or harmful software

5. Privacy and Data Usage

5.1 Privacy Policy

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your data.

5.2 Data Collection

By using the App, you consent to our collection and use of:

• Account information (name, email, profile picture)
• Intentional Timer session data (durations, timestamps, session types)
• Productivity Journal entries (ratings, reflections, notes)
• Streak and activity tracking data
• Productivity Coach interaction data
• App usage and preferences
• Device information for app functionality

5.3 Notification Permissions

By granting notification permissions, you consent to receive:

• Reminders for your intentional sessions
• Progress updates and streak notifications
• Important app updates and feature announcements

You can manage notification preferences in your device settings or within the App.

6. Intellectual Property Rights

6.1 Our Content

The App and its original content, features, and functionality are owned by SAGA, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of the content you create using our App (such as journal entries, reflections, and session data). By using the App, you grant us a limited, non-exclusive, royalty-free license to:

• Store and process your content to provide App functionality
• Use anonymized and aggregated data to improve our services
• Display your content within the App's features

6.3 User-Generated Content

You are solely responsible for the content you create and share through the App. We do not claim ownership of your personal journal entries, reflections, or other content.

7. Subscription Terms and Payment

7.1 Subscription Plans

SUPERSELF may offer subscription plans that provide access to premium features. Subscription details, pricing, and terms are displayed within the App and may be updated from time to time.

7.2 Payment Processing

• Payments are processed through secure third-party payment processors
• Subscriptions automatically renew unless cancelled before the renewal date
• Pricing is subject to change with notice to existing subscribers
• All payments are final and non-refundable except as required by law

7.3 Apple App Store Subscriptions

For iOS users, subscriptions are managed through the Apple App Store:

• Payment will be charged to your Apple ID account
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the current period ends
• You can manage subscriptions in your Apple ID Account Settings
• Refunds are subject to Apple's refund policy

7.4 Google Play Store Subscriptions

For Android users, subscriptions are managed through the Google Play Store:

• Payment will be charged to your Google Play account
• Subscriptions automatically renew unless cancelled
• You can manage subscriptions in your Google Play Account Settings
• Refunds are subject to Google's refund policy

7.5 Cancellation

You may cancel your subscription at any time through:

• Your Apple ID Account Settings (iOS users)
• Google Play Store settings (Android users)
• The subscription management section within the App

7.6 Free Trial

We may offer free trial periods for subscription plans, including a 7-day free trial for eligible users. If you do not cancel before the trial ends, you will be charged for the subscription.

8. App Store Terms

8.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge that:

• These Terms are between you and SAGA, LLC, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support
• Apple is not liable for any claims related to the App
• You comply with applicable third-party terms when using the App

8.2 Google Play Store

If you downloaded the App from the Google Play Store, you acknowledge that:

• These Terms are between you and SAGA, LLC, not Google
• Google is not responsible for the App or its content
• You comply with Google Play's terms of service

9. Limitation of Liability

9.1 Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

• The App's availability, reliability, or functionality
• The accuracy or completeness of content
• The results you may achieve using the App, including improvements in productivity, focus, or energy

9.2 Limitation of Damages

To the maximum extent permitted by law, SAGA, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits.

9.3 Maximum Liability

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Deleting the App from your device
• Contacting our support team at support@superself.app
• Following the account deletion process within the App

10.2 Termination by Us

We may terminate or suspend your account immediately if you:

• Violate these Terms or our policies
• Engage in harmful or inappropriate conduct
• Fail to pay subscription fees (if applicable)
• Use the App in a way that could harm our service or other users

10.3 Effect of Termination

Upon termination:

• Your access to the App will cease immediately
• Your content may be deleted from our servers
• Subscription benefits will end (subject to applicable refund policies)
• Certain provisions of these Terms will survive termination

11. Changes to Terms

11.1 Updates

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Notify you through the App or via email
• Update the "Last Updated" date at the top of these Terms
• Provide you with the opportunity to review the changes

11.2 Continued Use

Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App will be resolved through:

1. Good faith negotiations between the parties
2. Binding arbitration if negotiations fail (except for claims that may be brought in small claims court)
